00CS FOR SENATE BILL NO. 126(FIN) 01 "An Act making special appropriations to fund the energy authority revolving 02 fund; making special appropriations for design and construction of power 03 transmission interties between Anchorage and the Kenai Peninsula, between Healy 04 and Fairbanks, between the Swan Lake and Tyee Lake hydroelectric projects, and 05 between Sutton and Glennallen; making special appropriations for energy project 06 assistance, repair, improvements, acquisition, and development and for renewal and 07 replacement funds at facilities owned by the Alaska Energy Authority; and 08 providing for an effective date." 09 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 10 * Section 1. The balance in the Railbelt intertie reserve (sec. 159, ch. 208, SLA 1990) on 11 June 30, 1993, is appropriated from the Railbelt intertie reserve to the energy authority 12 revolving fund (AS 44.83.107) to capitalize the fund. 13 * Sec. 2. The sum of $90,000,000 is appropriated from the energy authority revolving fund 14 (AS 44.83.107) to the Alaska Energy Authority for design and construction of a power

01 transmission intertie of at least 138 kilovolts between Healy and Fairbanks and for design and 02 construction of a power transmission intertie of at least 138 kilovolts between Anchorage and 03 the Kenai Peninsula. 04 * Sec. 3. The sum of $35,000,000 is appropriated from the energy authority revolving fund 05 to the Alaska Energy Authority for the design and construction of a power transmission 06 intertie of at least 115 kilovolts between the Tyee Lake and Swan Lake hydroelectric projects. 07 * Sec. 4. The sum of $27,500,000 is appropriated from the energy authority revolving fund 08 to the Alaska Energy Authority for the design and construction of a power transmission 09 intertie of at least 138 kilovolts between Sutton and Glennallen. 10 * Sec. 5. The balance in the Railbelt energy fund (AS 37.05.520) on June 30, 1993, is 11 appropriated to the energy authority revolving fund (AS 44.83.107) to capitalize the fund. 12 * Sec. 6. (a) The unexpended and unobligated balance of the appropriation made in sec. 3, 13 ch. 128, SLA 1986, page 8, line 7, as amended by sec. 1, ch. 96, SLA 1987 (Alaska Power 14 Authority, Bradley Lake power project - $50,000,000) is repealed and reappropriated to the 15 energy authority revolving fund (AS 44.83.107) to capitalize the fund. 16 (b) The unexpended and unobligated balance of the appropriation made in sec. 6, 17 ch. 172, SLA 1988 (Bradley Lake power project - $7,000,000) is repealed and reappropriated 18 to the energy authority revolving fund (AS 44.83.107) to capitalize the fund. 19 * Sec. 7. (a) All right, title, and interest in loans described in (b) of this section as of 20 June 30, 1993, and all right, title, and interest in all mortgages, notes, power sales agreements, 21 reserves, and other instruments of security made in connection with those loans as of June 30, 22 1993, are transferred and appropriated to the Alaska Energy Authority to capitalize the energy 23 authority revolving fund (AS 44.83.107). 24 (b) This section transfers and appropriates 25 (1) power project fund loans made under former AS 44.83.170; 26 (2) rural electrification revolving loan fund loans made under former 27 AS 44.83.361 - 44.83.363; 28 (3) power development revolving loan fund loans made under former 29 AS 44.83.500 - 44.83.530; and 30 (4) bulk fuel loan fund loans made under former AS 44.83.600 - 44.83.650. 31 * Sec. 8. The sum of $2,100,000 is appropriated from the power development revolving

01 loan fund (AS 44.83.500(a)) to the Alaska energy revolving fund for the following purposes 02 in the amounts stated: 03 APPROPRIATION AMOUNT 04 Operation, technical, and emergency 05 assistance $1,100,000 06 Electrical system life, health, and 07 safety improvements 730,000 08 Rural utility regionalization, consolidation, 09 and business management training 270,000 10 * Sec. 9. The sum of $4,300,000 is appropriated from the general fund to the Alaska 11 energy revolving fund for the following purposes in the amounts stated: 12 APPROPRIATION AMOUNT 13 Rural power systems upgrade $ 650,000 14 Snettisham acquisition 50,000 15 Emergency bulk fuel repairs/prevention 500,000 16 Statewide electric and power project 17 development 250,000 18 Bulk fuel system upgrades 2,000,000 19 Alternative and applied energy 20 technology development 350,000 21 King Cove hydroelectric project 500,000 22 * Sec. 10. The Alaska energy revolving fund is authorized to receive and expend 23 $2,000,000 in program receipts from nonstate resources for statewide energy project 24 development. 25 * Sec. 11. The Alaska energy revolving fund is authorized to receive and expend 26 $5,000,000 in program receipts from nonstate or trustee held funds for renewal and 27 replacement funds at facilities owned by the Alaska Energy Authority. 28 * Sec. 12. The appropriations made by secs. 2 - 4 of this Act are for capital projects and 29 lapse under AS 37.25.020. 30 * Sec. 13. The appropriations made by secs. 1 and 5 - 7 of this Act are for capitalization 31 of a fund and do not lapse under AS 37.25.010.

01 * Sec. 14. The appropriations made by secs. 9 - 11 of this Act are for capital projects and 02 lapse under AS 37.25.020. 03 * Sec. 15. Section 2 of this Act takes effect on the effective date of an Act enacted by the 04 Eighteenth Alaska State Legislature that authorizes the Alaska Energy Authority to design and 05 construct power transmission interties between Healy and Fairbanks and between the Kenai 06 Peninsula and Anchorage. 07 * Sec. 16. Section 3 of this Act takes effect on the effective date of an Act enacted by the 08 Eighteenth Alaska State Legislature that authorizes the Alaska Energy Authority to design and 09 construct a power transmission intertie between the Tyee Lake and Swan Lake hydroelectric 10 projects. 11 * Sec. 17. Section 4 of this Act takes effect on the effective date of an Act enacted by the 12 Eighteenth Alaska State Legislature that authorizes the Alaska Energy Authority to design and 13 construct a power transmission intertie between Sutton and Glennallen. 14 * Sec. 18. Sections 1 and 5 - 11 of this Act take effect July 1, 1993, but only if a bill 15 establishing the energy authority revolving fund is enacted into law on or before that date.
