00SENATE BILL NO. 54 01 "An Act relating to violations of laws by juveniles; and providing for an effective 02 date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 47.10.010 is amended by adding new subsections to read: 05  (e) Except for a minor to whom the provisions of AS 47.10.080(o) apply, the 06 procedure prescribed in AS 47.10.020 - 47.10.090 and the Alaska Delinquency Rules 07 does not apply when a minor is 16 years of age and older and is charged with an 08 unclassified or a class A felony. 09  (f) If a minor is charged with an offense specified in (e) of this section, except 10 for a minor to whom the provisions of AS 47.10.080(o) apply, the procedure 11 prescribed in AS 47.10.020 - 47.10.090 and the Alaska Delinquency Rules does not 12 apply with regard to a charge that is properly joined to the offense described in (e) of 13 this section. 14  (g) Except as provided in AS 47.10.080(o), a minor accused of an offense

01 specified in (e) or (f) of this section shall be charged, prosecuted, and sentenced in the 02 superior court in the same manner as an adult. 03  (h) Nothing in this section limits the right of a party to an action under this 04 chapter to seek waiver of jurisdiction under AS 47.10.060(a). 05 * Sec. 2. AS 47.10.080 is amended by adding a new subsection to read: 06  (o) If a minor is charged and prosecuted as an adult under AS 47.10.010(e) - 07 (g), and the most serious offense of which the minor is convicted is a misdemeanor 08 or a felony with which the minor could not be charged under AS 47.10.010(e), the 09 minor shall be treated as though the charges had been heard under this chapter, and 10 the court shall order disposition of the charges of which the minor is convicted under 11 the provisions of (b) of this section. 12 * Sec. 3. APPLICABILITY. This Act applies to offenses committed after the effective 13 date of this Act. 14 * Sec. 4. This Act takes effect September 1, 1993.
