01 "An Act relating to waste disposal permits."                                                                            
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 46.03 is amended by adding a new section to read:                                                   
04  Sec. 46.03.125.  DELEGATION OF AUTHORITY.  The department may                                                         
05 delegate to a municipality, if the municipality is otherwise empowered, the authority                                   
06 to establish and administer a waste disposal permit program that operates in lieu of and                                
07 is consistent with the requirements of AS 46.03.100 - 46.03.120.  The department may                                    
08 not collect a fee based on a permit issued by a municipality that has been delegated                                    
09 permitting authority under this section.
