00HOUSE BILL NO. 489 01 "An Act repealing the state requirement to provide overtime compensation and 02 relating to liquidated damages for unpaid minimum wages." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 23.10.050 is amended to read: 05  Sec. 23.10.050. PUBLIC POLICY. It is the public policy of the state to 06  (1) establish a minimum wage standard [AND OVERTIME 07 COMPENSATION STANDARDS] for workers at a level [LEVELS] consistent with 08 their health, efficiency, and general well-being; [,] and 09  (2) safeguard the existing minimum wage standard [AND OVERTIME 10 COMPENSATION STANDARDS] that is [ARE] adequate to maintain the health, 11 efficiency, and general well-being of workers against the unfair competition of a wage 12 standard [AND HOUR STANDARDS] that does [DO] not provide an adequate 13 standard [STANDARDS] of living. 14 * Sec. 2. AS 23.10.110(a) is amended to read:

01  (a) An employer who violates a provision of AS 23.10.065 [AS 23.10.060 OR 02 23.10.065] is liable to an employee affected in the amount of unpaid minimum wages 03 [, OR UNPAID OVERTIME COMPENSATION, AS THE CASE MAY BE,] and, 04 unless the matter is resolved administratively, in an additional equal amount as 05 liquidated damages. 06 * Sec. 3. AS 23.10.130 is amended to read: 07  Sec. 23.10.130. STATUTE OF LIMITATIONS. An action for unpaid 08 minimum wages [, UNPAID OVERTIME COMPENSATION,] or liquidated damages 09 under AS 23.10.050 - 23.10.150 is forever barred unless it is started within two years 10 after the cause of action accrues. For the purposes of this section an action is 11 considered to be started on the date when the complaint is filed. 12 * Sec. 4. AS 23.10.060 is repealed.
