01 "An Act relating to community agreements for environmental conservation                                                 
02 purposes; and providing for an effective date."                                                                         
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 46.03.020 is amended by adding a new paragraph to read:                                             
05   (14)  enter into a community agreement consistent with relevant state                                                
06 and federal law either with a local governing body for an incorporated community or                                     
07 with a Native regional corporation, other local corporation, Native village council, or                                 
08 similar organization in an unincorporated community, and, as appropriate, with an                                       
09 agency of the federal government to                                                                                     
10   (A)  jointly assess the environmental conservation needs of the                                                     
11 community served by that governing body, corporation, council, or organization                                          
12 and to establish indicators to track progress in meeting those needs;                                                   
13   (B)  jointly assess and prioritize, by comparative risk to human                                                    
14 health and the environment, the needs assessed under (A) of this paragraph; and                                         

01   (C)  work jointly to resolve the needs assessed under (A) of this                                                   
02 paragraph through delegation or cooperative management, to the extent                                                   
03 allowable under the law, using local, state, and federal authorities and funding                                        
04 available to meet those needs.                                                                                          
05    * Sec. 2.  AS 46.03.020 is amended by adding a new subsection to read:                                               
06  (b)  Where appropriate, the portions of a community agreement under (a)(14)                                           
07 of this section that are related to emergency response shall be entered into jointly with                               
08 the Alaska State Emergency Response Commission.                                                                         
09    * Sec. 3.  This Act takes effect immediately under AS 01.10.070(c).
