00HOUSE BILL NO. 425 01 "An Act relating to hunting license and tag fees for citizens of Canada and 02 Mexico; relating to nonresident and nonresident alien hunting, trapping, sport 03 fishing, and other licenses, tags, and permits; relating to guide requirements for 04 nonresident and nonresident alien hunters; and providing for an effective date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. PURPOSE. (a) This bill provides that nonresidents who are citizens of 07 Canada and Mexico 08 (1) may obtain hunting licenses and big game tags for the same fee paid by 09 nonresidents who are not nonresident aliens; and 10 (2) are required to obtain the services of a licensed big game guide-outfitter 11 or a relative if they intend to take brown or grizzly bear, mountain goat, or sheep. 12 * Sec. 2. AS 16.05.330(a) is repealed and reenacted to read: 13  (a) Except as otherwise permitted in this chapter, without having the 14 appropriate license or tag in actual possession a person may not engage in sport

01 fishing, including the taking of razor clams; hunting; trapping; fur dealing; taxidermy; 02 or the farming of fish, fur, or game. A person who is a nonresident may not engage 03 in an activity listed in this subsection without having the appropriate nonresident 04 license or tag in actual possession. A nonresident who is a nonresident alien may not 05 engage in hunting without having the appropriate nonresident alien hunting license or 06 big game tag in actual possession. 07 * Sec. 3. AS 16.05.330(b) is amended to read: 08  (b) When obtaining the appropriate license or tag in (a) of this section, an 09 applicant who asserts residency in the state or citizenship in the United States, 10 Canada, or Mexico shall provide the license vendor with the proof of residence or 11 citizenship that the department requires by regulation. 12 * Sec. 4. However, members of the military service on 18 active duty who are permanently stationed in the state, and their dependents, who do 19 not qualify as residents under AS 16.05.940, may obtain an annual nonresident military 20 anadromous king salmon tag for $20. 21 * Sec. 5. AS 16.05.940(22) is amended to read: 22  (22) "nonresident alien" means a person who is not a citizen of the United 23 States, Canada, or Mexico and whose permanent place of abode is not in the United 24 States; 25 * Sec. 6. Notwithstanding AS 16.05.940(22), as amended by sec. 5 of this Act, a person 26 who is a citizen of Canada or Mexico and whose permanent place of abode is not in the 27 United States may not hunt, pursue, or take a big game animal as defined by the Board of 28 Game or a marine mammal before January 1, 1996, unless the person has complied with 29 AS 16.05.408. 30 * Sec. 7. This Act takes effect January 1, 1995.
