00HOUSE BILL NO. 419 01 "An Act transferring the responsibility to license security guards and security 02 guard agencies from the Department of Public Safety to the Department of 03 Commerce and Economic Development." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 08.01.010 is amended by adding a new paragraph to read: 06 (35) regulation of security guards and security guard agencies under 07 AS 18.65.400 - 18.65.490. 08 * Sec. 2. AS 18.65.400 is amended to read: 09 Sec. 18.65.400. LICENSE AS SECURITY GUARD. A person may not be 10 employed as a security guard or security guard agency until the person has obtained 11 a license from the Department of Commerce and Economic Development 12 [COMMISSIONER OF PUBLIC SAFETY] under AS 18.65.400 - 18.65.490. 13 * Sec. 3. AS 18.65.490(1) is repealed and reenacted to read: 14 (1) "department" means the Department of Commerce and Economic
01 Development; 02 * Sec. 4. TRANSITION. (a) Litigation, hearings, investigations, and other proceedings 03 pending under AS 18.65.400 - 18.65.490 before the effective date of this Act continue in 04 effect and may be continued and completed notwithstanding the transfer of functions under 05 this Act. 06 (b) Contracts, rights, liabilities, and obligations created by or under a law amended 07 under this Act and in effect on the effective date of this Act remain in effect, notwithstanding 08 the Act's taking effect. Records, equipment, appropriations, and other property of the 09 Department of Public Safety shall be transferred to the Department of Commerce and 10 Economic Development to the extent consistent with the transfer of functions under this Act. 11 (c) The regulations of the Department of Public Safety that govern the functions 12 transferred under this Act remain in effect and may be implemented and enforced by the 13 Department of Commerce and Economic Development until the Department of Commerce and 14 Economic Development adopts regulations to govern the functions transferred under this Act 15 and those regulations take effect. 16 * Sec. 5. REVISOR'S INSTRUCTION. Wherever in AS 18.65.400 - 18.65.480, the term 17 "commissioner" appears, the revisor of statutes shall substitute the term "department" when 18 to do so would be consistent with the purpose of this Act. Wherever in the Administrative 19 Code, the term "commissioner of public safety" or "Department of Public Safety" is used with 20 respect to the licensure of security guards and security guard agencies, the regulations attorney 21 shall substitute the term "department" and "Department of Commerce and Economic 22 Development" when to do so would be consistent with the purpose of this Act.
