00HOUSE BILL NO. 395 01 "An Act relating to retirement benefits for the administrative director of courts; 02 and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 22.25.012(a) is amended to read: 05  (a) An administrative director of the Alaska court system appointed under art. 06 IV, sec. 16 of the state constitution is entitled to retirement benefits under this chapter 07 on the terms and conditions applicable to a superior court judge appointed after July 1, 08 1978, if the administrative director elects to participate in this chapter before the 09 effective date of this Act. However, [EXCEPT THAT] an administrative director 10 may receive retirement benefits only with service as administrative director for 10 or 11 more years. 12 * Sec. 2. AS 39.35.158 is amended to read: 13  Sec. 39.35.158. ADMINISTRATIVE DIRECTOR OF COURTS. (a) Except 14 as provided in AS 22.25.012, an [AN] administrative director of the Alaska court

01 system is a member of this system. 02  (b) An administrative director who has been a member of the judicial 03 retirement system under AS 22.25.012 and who later withdraws from the judicial 04 retirement system under AS 22.25.012 is eligible for membership in the system and 05 shall receive credited service in the system for service rendered as administrative 06 director. To be eligible for membership in the system under this subsection, the 07 administrative director must contribute to the system 08  (1) the amount the director would have contributed if the director had 09 been a member during the director's period of membership in the judicial retirement 10 system; and 11  (2) any contributions for services as administrative director refunded 12 by the system at the time the director became a member of the judicial retirement 13 system. 14 * Sec. 3. AS 39.35.680(21)(C)(vii) is repealed. 15 * Sec. 4. This Act takes effect immediately under AS 01.10.070(c).
