01 "An Act relating to violations of laws by juveniles."                                                                   
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.   AS 47.10.010 is amended by adding a new subsection to read:                                           
04  (e)  When a minor who was at least 13 years of age at the time an offense was                                         
05 committed is arraigned for the offense and at any time during the commission of the                                     
06 offense the minor had possession of a firearm or a knife and used or threatened to use                                  
07 the firearm or knife during the commission of the offense, AS 47.10.020 - 47.10.090                                     
08 and the Alaska Delinquency Rules do not apply to the offense for which the minor is                                     
09 arraigned or to any additional offenses joinable to it under the applicable rules of court                              
10 governing criminal procedure.  Notwithstanding the requirement of AS 47.10.060(a)                                       
11 relating to a finding of probable cause, the minor shall be charged, prosecuted, and                                    
12 sentenced in the superior court in the same manner as an adult.  In this subsection,                                    
13 "firearm" has the meaning given in AS 11.81.900.                                                                        
14    * Sec. 2.  APPLICABILITY.  This Act applies to offenses committed on or after the                                    

01 effective date of this Act.
