01 "An Act relating to requests for anatomical gifts and to the release of certain                                         
02 information for the purpose of facilitating anatomical gifts."                                                          
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 13.50 is amended by adding a new section to read:                                                   
05  Sec. 13.50.018.  PROCEDURES REQUIRED.  Unless the person is already                                                   
06 required by AS 13.50.014(b) to adopt the procedures, a person who is a bank or                                          
07 storage facility or who handles the procurement of anatomical requests shall develop                                    
08 procedures that specify the circumstances under which it is inappropriate to request a                                  
09 gift, such as if the gift is unsuitable, if the request is likely to offend the donor's                                 
10 religious beliefs, or if making the request is likely to cause undue emotional distress                                 
11 to the person who would be making the gift.  The procedures must encourage                                              
12 reasonable discretion and sensitivity.                                                                                  
13    * Sec. 2.  AS 13.50 is amended by adding a new section to read:                                                      
14  Sec. 13.50.063.  REQUESTS FOR FETAL TISSUE OR PARTS.                                                                  

01 Notwithstanding the other provisions of this chapter, a person may not request an                                       
02 anatomical gift if the gift includes tissue or other parts of a human fetus whose death                                 
03 was caused by an induced abortion.                                                                                      
04    * Sec. 3.  AS 18.50.310 is amended by adding a new subsection to read:                                               
05  (i)  If, to facilitate an anatomical gift under AS 13.50, a person who is a bank                                      
06 or storage facility or who handles the procurement of anatomical gifts requests                                         
07 information contained in or collected by the department for the purpose of completing                                   
08 death certificates or other vital records, the department may release the requested                                     
09 information to the requestor, except that the department may not release information                                    
10 that facilitates an anatomical gift of the tissue or other parts of a human fetus whose                                 
11 death was caused by an induced abortion.  The information released may include                                          
12 information relating to the medical suitability of the potential gift for the intended                                  
13 purpose and the names of the persons who are identified in AS 13.50.010(b).  In this                                    
14 subsection, "bank or storage facility" has the meaning given in AS 13.50.070.
