00HOUSE BILL NO. 310 01 "An Act relating to disposals of state land within five miles of the right-of-way 02 of the Dalton Highway to a licensed public utility or a licensed common carrier; 03 and relating to leases and materials sales for nodes of development of facilities 04 and services along the Dalton Highway." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. AS 19.40.200(b) is amended to read: 07 (b) The prohibition on disposal of state land under (a) of this section does not 08 apply to a disposal 09 (1) under AS 38.05.810(e); or 10 (2) necessary for 11 (A) [(1)] an oil and gas lease under AS 38.05.180; 12 (B) [(2)] exploration, development, production, or transportation 13 of oil and gas north of 68 degrees north latitude; or 14 (C) [(3)] a state lease or materials sale for
01 (i) exploration, development, production, or 02 transportation of oil and gas or reconstruction or maintenance of the 03 highway north of 68 degrees north latitude; or 04 (ii) the construction of facilities and the provision of 05 services along the highway that are located only in nodes of 06 development identified jointly by the commissioners of 07 transportation, fish and game, and natural resources.
