01 "An Act relating to disposals of state land within five miles of the right-of-way                                       
02 of the Dalton Highway to a licensed public utility or a licensed common carrier."                                       
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 19.40.200(b) is amended to read:                                                                    
05  (b)  The prohibition on disposal of state land under (a) of this section does not                                     
06 apply to a disposal                                                                                                     
07   (1)  under AS 38.05.810(e); or                                                                                      
08   (2)  necessary for                                                                                                  
09   (A) [(1)]  an oil and gas lease under AS 38.05.180;                                                               
10    (B) [(2)]  exploration, development, production, or transportation                                                
11 of oil and gas north of 68 degrees north latitude; or                                                                   
12   (C) [(3)]  a state lease or materials sale for exploration,                                                       
13 development, production, or transportation of oil and gas or reconstruction or                                          
14 maintenance of the highway north of 68 degrees north latitude.
