00SENATE CS FOR CS FOR HOUSE BILL NO. 302(JUD) 01 "An Act excluding certain sports officials and certain recreational activities 02 sanctioned by an employer from coverage provided under workers' compensation; 03 and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 23.30.230(a) is amended to read: 06  (a) The following persons are not covered by this chapter: 07  (1) part-time baby-sitters; 08  (2) cleaning persons; 09  (3) harvest help and similar part-time or transient help; 10  (4) persons employed as sports officials on a contractual basis 11 and who officiate only at sports events in which the players are not compensated; 12 in this paragraph, "sports official" includes an umpire, referee, judge, 13 scorekeeper, timekeeper, organizer, or other person who is a neutral participant 14 in a sports event;

01  (5) persons employed as entertainers on a contractual basis; 02  (6) [(5)] commercial fishermen, as defined in AS 16.05.940; and 03  (7) [(6)] individuals who drive taxicabs whose compensation and 04 written contractual arrangements are as described in AS 23.10.055(13), unless the 05 hours worked by the individual or the areas in which the individual may work are 06 restricted except to comply with local ordinances. 07 * Sec. 2. AS 23.30.265(2) is amended to read: 08  (2) "arising out of and in the course of employment" includes 09 employer-required or supplied travel to and from a remote job site; activities performed 10 at the direction or under the control of the employer; and employer-sanctioned 11 activities at employer-provided facilities; but excludes recreational activities 12 sponsored by the employer, unless participation is required as a condition of 13 employment, and activities of a personal nature away from employer-provided 14 facilities; 15 * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).
