00HOUSE BILL NO. 191 01 "An Act relating to cost recovery by contractors who operate state-owned 02 hatcheries." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 16.10.480(c) is amended to read: 05 (c) Except as otherwise provided in this section, a [A] contract entered into 06 under this section must provide that the hatchery will be operated under 07 AS 16.10.400 - 16.10.470 [AS 16.10.400 - 16.10.445 AND 16.10.460 - 16.10.470] and 08 the regulations adopted under those sections. 09 * Sec. 2. AS 16.10.480(d) is amended to read: 10 (d) The department may issue to a contractor who operates a hatchery under 11 this section a permit to harvest adult salmon during the term of the contract at 12 locations designated by the department. The contractor shall use funds received 13 from the sale of adult salmon harvested under the permit [IN A QUANTITY 14 SUFFICIENT TO ALLOW THE CONTRACTOR] to recover all or part of the
01 [CONTRACTOR'S] costs of operating the hatchery and may use the remaining 02 funds for improvements to the hatchery or other salmon enhancement or 03 rehabilitation projects, fisheries research, or the contractor's reasonable operating 04 or administrative costs in the region in which the hatchery is located including 05 debt retirement or for other fisheries activities of the contractor.
