00CS FOR HOUSE BILL NO. 153(JUD) am 01 "An Act related to the awarding of special good time deductions for prisoners 02 participating in the Point MacKenzie Rehabilitation Project; and providing for an 03 effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 33.20 is amended by adding a new section to read: 06 Sec. 33.20.021. SPECIAL GOOD TIME. (a) Notwithstanding 07 AS 12.55.125(f)(3) and 12.55.125(g)(3), the commissioner shall, upon the 08 recommendation of the project manager of the Point MacKenzie Rehabilitation Project, 09 award a prisoner serving a sentence of at least 60 days and voluntarily participating 10 in the Point MacKenzie Rehabilitation Project three days special good time deduction 11 from the prisoner's sentence for each 30 days the prisoner successfully completes as 12 a participant in the project. A prisoner is not entitled to a special good time deduction 13 under this section until it is actually awarded. If it is awarded, special good time shall 14 be awarded during the month following the month for which the special good time is
01 earned. 02 (b) The project manager of the Point MacKenzie Rehabilitation Project, upon 03 review of a prisoner's behavior, shall recommend to the Commissioner whether to 04 award or deny special good time, in whole or in part, to a prisoner. 05 (c) Special good time awarded under (a) of this section shall be forfeited in 06 whole or in part if the prisoner is involuntarily removed from the Point MacKenzie 07 Rehabilitation Project because of inappropriate behavior. The project manager of the 08 Point MacKenzie Rehabilitation Project shall post for or distribute to the inmates 09 participating in the project a description of appropriate or inappropriate behavior. 10 * Sec. 2. AS 33.20.030 is amended to read: 11 Sec. 33.20.030. DISCHARGE. A prisoner shall be released at the expiration 12 of the term of sentence less the time deducted for good time and special good time 13 [CONDUCT]. A certificate of deduction shall be entered on the commitment by the 14 warden, keeper, or the commissioner. 15 * Sec. 3. TRANSITIONAL PROVISION. Notwithstanding sec. 6 of this Act, the 16 commissioner of corrections may, upon the recommendation of the project manager of the 17 Point MacKenzie Rehabilitation Project, award special good time as provided in AS 33.20.021, 18 added by sec. 1 of this Act, to prisoners, qualified to receive special good time under 19 AS 33.20.021, added by sec. 1 of this Act, who are voluntarily participating in the Point 20 MacKenzie Rehabilitation Project on the effective date of this section for each complete month 21 the prisoner has successfully completed in the project before the effective date of this section. 22 The special good time shall be awarded, and is subject to forfeiture in the manner provided 23 in AS 33.20.021, added by sec. 1 of this Act. 24 * Sec. 4. TRANSITIONAL PROVISION. Notwithstanding sec. 6 of this Act, the 25 commissioner of corrections may proceed to adopt regulations necessary to implement secs. 1 26 and 2 of this Act. The regulations may not take effect before July 1, 1994. 27 * Sec. 5. Section 4 of this Act takes effect immediately under AS 01.10.070(c). 28 * Sec. 6. Sections 1 - 3 of this Act take effect July 1, 1994.
