00HOUSE BILL NO. 150 01 "An Act relating to workers' compensation for a fire fighter and for a person 02 volunteering as a fire fighter; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 23.30.243(a) is amended to read: 05 (a) For the purposes of workers' compensation any injury, disability or death 06 incurred by a fire fighter by reason of the fire fighter's participation in training, 07 proceeding to or engaging in a fire suppression or rescue operation, or the protection 08 or preservation of life or property, anywhere in the state is considered to have arisen 09 out of and been sustained in the course of employment, and the fire department or 10 regularly organized volunteer fire department of the fire fighter's primary employment 11 or registration is considered to be the employer, except when the injured, at the time 12 of injury or death, is acting for compensation from another person or when the 13 regularly organized volunteer fire department is not located within a municipality. 14 If the regularly organized volunteer fire department is not located within a
01 municipality, the state shall be considered the employer for purposes of this 02 chapter. 03 * Sec. 2. This Act takes effect July 1, 1993.
