00HOUSE BILL NO. 63 01 "An Act prohibiting the sale or purchase of parts of bears and relating to 02 possession and use of bear gall bladders." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 16.05.255 is amended by adding a new subsection to read: 05  (e) The Board of Game may adopt regulations regarding the possession and 06 personal use of bear gall bladders. 07 * Sec. 2. AS 16.05.920 is amended by adding a new subsection to read: 08  (c) A person may not intentionally or knowingly sell, purchase, offer to sell 09 or purchase, or possess for sale the meat, hide, teeth, claws, or other parts of a brown 10 or black bear. A person who violates this subsection is guilty of a class C felony; 11 however, the fine that may be imposed for violations of this subsection may not 12 exceed $100,000. It is an affirmative defense to a prosecution under this subsection 13 that a bear skin or bear trophy was purchased or offered to be purchased from, or sold 14 or offered to be sold by, or possessed for sale by

01  (1) a taxidermist licensed under this chapter, an estate executor, or a 02 bankruptcy referee under the terms of a permit issued by the department; or 03  (2) the state as excess property. 04 * Sec. 3. AS 16.05.925 is amended to read: 05  Sec. 16.05.925. PENALTY FOR VIOLATIONS. Except as provided in 06 AS 16.05.430, 16.05.722, 16.05.723, 16.05.831, [AND] 16.05.860, and 16.05.920(c), 07 a person who violates AS 16.05.920 or 16.05.921, or a regulation adopted under this 08 chapter or AS 16.20, is guilty of a class A misdemeanor. 09 * Sec. 4. The Board of Game shall, by January 1, 1994, adopt regulations restricting 10 possession and personal use of black bear and brown bear gall bladders under 11 AS 16.05.255(e), added by sec. 1 of this Act.
