00CS FOR HOUSE BILL NO. 51(L&C) 01 "An Act making special appropriations for design and construction of power 02 transmission interties between Anchorage and the Kenai Peninsula, between Healy 03 and Fairbanks, between Sutton and Glennallen, and between the Swan Lake and 04 Tyee Lake hydroelectric projects, for the Alaska Energy Authority, and to fund 05 the four dam pool account and the Railbelt intertie reserve; and providing for 06 an effective date." 07 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 08 * Section 1. The sum of $112,250,000 and the interest earned on that sum beginning on 09 the effective date of this Act is appropriated from the funding sources stated in this section 10 to the Alaska Energy Authority for design and construction of a power transmission intertie 11 between Anchorage and the Kenai Peninsula, for design and construction of a power 12 transmission intertie between Healy and Fairbanks, and for the design and construction of a 13 power transmission intertie between Sutton and Glennallen. The money appropriated by this 14 section is appropriated from the balance of the Railbelt intertie reserve (sec. 159, ch. 208, SLA

01 1990) and, if that amount is insufficient to satisfy this appropriation, the remaining balance 02 of the appropriation is appropriated from the Railbelt energy fund (AS 37.05.520). 03 * Sec. 2. (a) The sum of $20,000,000 is appropriated from the Railbelt energy fund in the 04 general fund (AS 37.05.520) to the four dam pool account in the power development revolving 05 loan fund in the Alaska Energy Authority to enable the authority to make a loan to itself for 06 design and construction of a power transmission intertie between Swan Lake and Tyee Lake. 07 (b) It is the intent of the legislature that the loan entered into by the authority under 08 (a) of this section provide for interest at a rate of three percent of the unpaid balance of the 09 loan and for the repayment of principal at a rate of $1,000,000 during fiscal year 1994, 10 $2,000,000 in fiscal year 1995, $3,000,000 in fiscal year 1996, and $4,000,000 each year 11 thereafter until the loan is repaid. 12 (c) It is the intent of the legislature that the remaining amount necessary for the 13 construction of the intertie for which an appropriation is made by this section be paid through 14 revenue bonds. 15 (d) It is the intent of the legislature that the amount appropriated by (a) of this section 16 will be repaid to the Railbelt energy fund through annual appropriations from the four dam 17 pool account in the power development revolving loan fund (AS 44.83.500). 18 * Sec. 3. (a) The sum of $800,000 is appropriated from the four dam pool account in the 19 power development revolving loan fund (AS 44.83.500) to the Alaska Energy Authority for 20 operating expenses for fiscal year 1994. 21 (b) It is the intent of the Eighteenth Alaska State Legislature that the legislature should 22 appropriate $800,000 from the four dam pool account for the Alaska Energy Authority's 23 expenses each year. 24 * Sec. 4. (a) The sum of $8,000,000 is appropriated from the four dam pool account in 25 the power development revolving loan fund (AS 44.83.500) to the Alaska Energy Authority 26 for preparation of environmental impact statements and related studies concerning the power 27 transmission interties between Swan Lake and Tyee Lake and between Sutton and Glennallen. 28 (b) The appropriation made by (a) of this section lapses into the four dam pool 29 account June 30, 1997. 30 * Sec. 5. The unexpended and unobligated balances of the following appropriations are 31 repealed and reappropriated to the Railbelt intertie reserve (sec. 159, ch.208, SLA 1990):

01 (1) that portion of the appropriation made by sec. 25, ch. 80, SLA 1979, page 02 66, line 38, as amended by sec. 448(a), ch. 105, SLA 1985, and sec. 275(a), ch. 130, SLA 03 1986, that is allocated by sec. 25, ch. 80, SLA 1979, page 67, line 5 (Bradley Lake hydro 04 project - $80,000); 05 (2) that portion of the appropriation made by sec. 1(a), ch. 90, SLA 1981, as 06 amended by sec. 69, ch. 92, SLA 1981, and sec. 236, ch. 141, SLA 1982, that is allocated by 07 sec. 1(a)(1), ch. 90, SLA 1981, as amended by sec. 69, ch. 92, SLA 1981 (Bradley Lake - 08 $5,000,000); 09 (3) that portion of the appropriation made by sec. 1(b), ch. 90, SLA 1981, as 10 amended by sec. 69, ch. 92, SLA 1981, and sec. 236, ch. 141, SLA 1982, that is allocated by 11 sec. 1(b)(1), ch. 90, SLA 1981, as amended by sec. 69, ch. 92, SLA 1981 (Bradley Lake - 12 $10,000,000); 13 (4) sec. 241, ch. 141, SLA 1982 (Bradley Lake hydroelectric project - 14 $3,000,000); 15 (5) AS 44.83.420, repealed by sec. 318, ch. 171, SLA 1984 (Bradley Lake 16 hydroelectric project); 17 (6) sec. 5, ch. 41, SLA 1986 (Bradley Lake hydroelectric project - 18 $50,000,000); 19 (7) sec. 3, ch. 128, SLA 1986, page 8, line 7, as amended by sec. 1, ch. 96, 20 SLA 1987 (Alaska Power Authority, Bradley Lake hydroelectric project - $50,000,000); 21 (8) sec. 6, ch. 172, SLA 1988 (Bradley Lake power project - $7,000,000). 22 * Sec. 6. The appropriation made by sec. 3 of this Act lapses into the fund from which 23 appropriated June 30, 1994. 24 * Sec. 7. The appropriations made by secs. 1 and 2 of this Act are for capital projects and 25 lapse under AS 37.25.020. 26 * Sec. 8. This Act takes effect on the effective date of an Act enacted by the Eighteenth 27 Alaska State Legislature that authorizes the Alaska Energy Authority to design and construct 28 power transmission interties between Anchorage and the Kenai Peninsula, between Healy and 29 Fairbanks, between Sutton and Glennallen, and between the Swan Lake and the Tyee Lake 30 hydroelectric projects.
