01 Proposing an amendment to the Constitution of the State of Alaska requiring the                                         
02 governor to submit a balanced budget to the legislature; and providing for an effective                                 
03 date for the amendment.                                                                                                 
04 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
05    * Section 1. Article IX, sec. 12, Constitution of the State of Alaska, is amended to read:                         
06 Section 12. Budget. (a) The governor shall submit to the legislature, at a time                                   
07 fixed by law, a budget for the next fiscal year setting forth all proposed expenditures                                 
08 and anticipated income of all departments, offices, and agencies of the State. The                                      
09 governor, at the same time, shall submit a general appropriation bill to authorize the                                  
10       proposed expenditures, and a bill or bills covering recommendations in the budget for                             
11       new or additional revenues.                                                                                       
12    * Sec. 2. Article IX, sec. 12, Constitution of the State of Alaska, is amended by adding a                         
13 new subsection to read:                                                                                                 
14            (b)  The governor may not submit under (a) of this section a budget proposing                                
15       expenditures or a general appropriation bill authorizing expenditures for the next fiscal                         
01 year that exceed available fund balances, anticipated revenue of all departments,                                       
02 offices, and agencies of the State for the next fiscal year, and income of the permanent                                
03 fund available for appropriation as authorized by law. Under this subsection, available                                 
04 fund balances do not include money in the budget reserve fund established under                                         
05 Section 17 of this article or the income of the permanent fund, whether deposited in                                    
06 the general fund or another fund, that exceeds the amount available for appropriation                                   
07       as authorized by law.                                                                                             
08    * Sec. 3. Article XV, Constitution of the State of Alaska, is amended by adding a new                              
09 section to read:                                                                                                        
10 Section 30. Application of Amendment relating to the Governor's Duty to                                               
11 Submit a Balanced Budget. The 2026 amendment relating to the governor's duty to                                       
12 submit a balanced budget (art. IX, sec. 12(b)) applies to budgets submitted by the                                      
13       governor on or after January 1, 2027.                                                                             
14    * Sec. 4. The amendment proposed by this resolution shall be placed before the voters of the                       
15 state at the next general election in conformity with art. XIII, sec. 1, Constitution of the State                      
16 of Alaska, and the election laws of the state.
