01 "An Act relating to the reclassification of first class cities as second class cities; and                              
02 providing for an effective date."                                                                                       
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 29.04 is amended by adding a new section to read:                                                  
05 Sec. 29.04.045. Reclassification of first class cities with less than 400                                             
06 permanent residents. (a) Notwithstanding AS 29.04.040, a first class city with a                                      
07 population of less than 400 persons based on the most recent decennial census                                           
08 conducted by the United States Bureau of the Census may be reclassified as a second                                     
09 class city if the council submits a written request to the Local Boundary Commission.                                   
10 (b)  If the Local Boundary Commission verifies that the population of the city                                          
11 is less than 400 persons based on the most recent decennial census conducted by the                                     
12 United States Bureau of the Census, the Local Boundary Commission shall, within 10                                      
13 days after receiving the request, notify the council that the city is eligible for                                      
14       reclassification as a second class city.                                                                          
01 (c)  After the Local Boundary Commission notifies the council of the city's                                             
02 eligibility for reclassification, the council has 30 days to reject the reclassification. If                            
03 the council rejects the reclassification, the council may not petition the department for                               
04 reclassification for a period of one year after transmitting the rejection to the Local                                 
05 Boundary Commission. If the council does not reject the reclassification, the                                           
06       reclassification takes effect 60 days after the date of notification of eligibility.                              
07    * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
