00 SENATE BILL NO. 132 01 "An Act exempting veterinarians from the requirements of the controlled substance 02 prescription database." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04  * Section 1. AS 17.30.200(o) is amended to read: 05 (o) The board shall promptly notify the State Medical Board, the Board of 06 Nursing, the Board of Dental Examiners, and the Board of Examiners in Optometry [, 07 AND THE BOARD OF VETERINARY EXAMINERS] when a practitioner registers 08 with the database under (n) of this section. 09  * Sec. 2. AS 17.30.200(t) is amended to read: 10 (t) A practitioner or a pharmacist is not required to comply with the 11 requirements of (a) and (b) of this section if 12 (1) the practitioner is a veterinarian licensed under AS 08.98; or  13 (2) a controlled substance is 14 (A) [(1)] administered to a patient at 01 (i) [(A)] a health care facility; or 02 (ii) [(B)] a correctional facility; or  03 (B) [(2)] dispensed to a patient for an outpatient supply of 24 04 hours or less at a hospital 05 (i) [(A)] inpatient pharmacy; or 06 (ii) [(B)] emergency department. 07  * Sec. 3. AS 17.30.200(u) is amended by adding a new paragraph to read: 08 (6) "practitioner" 09 (A) means a physician, dentist, advanced practice registered 10 nurse, optometrist, scientific investigator, or other person licensed, registered, 11 or otherwise permitted to distribute, dispense, conduct research with respect to, 12 or to administer or use in teaching or chemical analysis a controlled substance 13 in the course of professional practice or research in the state; 14 (B) means a pharmacy, hospital, or other institution licensed, 15 registered, or otherwise permitted to distribute, dispense, conduct research with 16 respect to, or to administer a controlled substance in the course of professional 17 practice or research in the state; 18 (C) does not include a veterinarian. 19  * Sec. 4. AS 08.98.050(a)(10) is repealed.
