01 "An Act relating to liability for COVID-19 vaccines."                                                                   
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 09.65 is amended by adding a new section to read:                                                    
04 Sec. 09.65.355. Liability of entities that encourage the administration of a                                            
05 COVID-19 vaccine. (a) Notwithstanding AS 09.50.250 and AS 09.65.070, an                                                 
06 employer who incentivizes, induces, or encourages an employee or a family member                                        
07 of an employee to accept administration of a vaccine for novel coronavirus disease                                      
08 (COVID-19) is civilly liable for damages incurred by the employee or family member                                      
09 of the employee as the result of an adverse reaction to the COVID-19 vaccine if the                                     
10       employee or family member of the employee obtained the COVID-19 vaccine as a                                      
11       result of the employer's incentive, inducement, or encouragement.                                                 
12            (b)  In this section,                                                                                        
13                 (1)  "COVID-19 vaccine" includes the primary dose and any additional                                    
14       booster dose;                                                                                                     
15                 (2)  "family member" means an individual who lives in the same                                          
01       household as an employee.
