01 "An Act prohibiting the Department of Health and Social Services from receiving or                                      
02 expending funds for a grant to or contract with an entity that performs abortions or                                    
03 maintains or operates a facility where abortions are performed; and prohibiting the                                     
04 Department of Health and Social Services from paying for abortion services."                                            
05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
06    * Section 1. AS 18.05.030 is amended by adding a new subsection to read:                                           
07 (b)  The department may not receive or expend funds for family planning                                                 
08 services under 42 U.S.C. 300 - 300a-8 (Title X, Public Health Service Act) to make a                                    
09 grant to or enter into a contract with an entity that performs abortions or maintains or                                
10       operates a facility where abortions are performed. This subsection is not subject to                              
11       judicial review. In this subsection, "abortion" has the meaning given in AS 18.16.090.                            
12    * Sec. 2. AS 47.07.068 is repealed and reenacted to read:                                                          
13            Sec. 47.07.068. Payment for abortions. The department may not pay for                                      
14       abortion services under this chapter. This section is not subject to judicial review. In
