00 HOUSE BILL NO. 191 01 "An Act relating to borough school district budgets; relating to the time required for 02 school districts to notify tenured teachers of layoff or nonretention; and providing for an 03 effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05  * Section 1. AS 14.14.060(c) is amended to read: 06 (c) Except as otherwise provided by municipal ordinance, the borough school 07 board shall submit the school budget for the following school year to the borough 08 assembly by May 1 for approval of the total amount. If the legislature has not yet  09 appropriated an amount to fund public education for the following school year,  10 the borough school board shall develop the budget for the following school year  11 based on the amount the legislature appropriated to fund public education in the  12 current school year. Within 30 days after receipt of the budget, the assembly shall 13 determine the total amount of money to be made available from local sources for 14 school purposes and shall furnish the school board with a statement of the sum to be 01 made available. If the assembly does not, within 30 days, furnish the school board 02 with a statement of the sum to be made available, the amount requested in the budget 03 is automatically approved. Except as otherwise provided by municipal ordinance, by 04 June 30, the assembly shall appropriate the amount to be made available from local 05 sources from money available for the purpose. 06  * Sec. 2. AS 14.20.140(a) is amended to read: 07 (a) If a teacher who has acquired tenure rights is to be laid off under 08 AS 14.20.177 or is not to be retained for the following school year, the employer shall 09 notify the teacher of the layoff or nonretention by writing, delivered before June 15 10 [MAY 15], or by registered mail postmarked before June 15 [MAY 15]. 11  * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 12 read: 13 APPLICABILITY. AS 14.20.140(a), as amended by sec. 2 of this Act, applies to a 14 contract or collective bargaining agreement that becomes legally binding on or after the 15 effective date of this Act. 16  * Sec. 4. This Act takes effect January 1, 2022.
