01 "An Act relating to the transferability of hunts awarded by drawing; and providing for                                  
02 an effective date."                                                                                                     
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 16.05 is amended by adding a new section to read:                                                  
05 Sec. 16.05.404. Transferability of hunting permits awarded by drawing.                                                
06 (a) The department may transfer or reissue a hunting permit for a hunt that was                                         
07 originally awarded to a resident by drawing established by the Board of Game under                                      
08 AS 16.05.255(a) to a qualified substitute, if the person to whom the hunting permit                                     
09 was originally awarded has died and the person's spouse, or if there is no spouse, an                                   
10       immediate family member of the decedent,                                                                          
11                 (1)  applies for the hunting permit to be transferred or reissued to a                                  
12       qualified substitute named in the application; and                                                                
13                 (2)  provides proof acceptable to the department of the person's death.                                 
14            (b)  To qualify as a substitute under this section, an individual must be a state                            
01       resident.                                                                                                         
02            (c)  An application to transfer or reissue a hunting permit under this section                               
03       may be made only before the end of the period during which the hunting permit is                                  
04       valid.                                                                                                            
05 (d)  A hunting permit may only be transferred or reissued under this section to                                         
06 a substitute who is qualified under the conditions that applied to the person to whom                                   
07 the hunting permit was originally awarded. A hunting permit may be transferred or                                       
08 reissued under this section only for the specific hunt for which the permit was                                         
09       originally awarded.                                                                                               
10 (e)  In this section, "immediate family member" means a parent, sibling, or                                             
11       child related by blood, marriage, or adoption.                                                                    
12    * Sec. 2. AS 16.05.420(c) is amended to read:                                                                      
13 (c)  A person to whom a license, tag, or sport fishing vessel registration has                                          
14 been issued under this chapter may not alter, change, loan, or transfer the license, tag,                               
15 or sport fishing vessel registration. Except for a hunting permit originally awarded                                
16 by drawing established by the Board of Game under AS 16.05.255(a) that has                                          
17 been transferred or reissued under AS 16.05.404, a [A] person may not use a                                         
18 license, tag, or sport fishing vessel registration that has been issued under this chapter                              
19       to another person.                                                                                                
20    * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).
