00 CS FOR HOUSE BILL NO. 63(TRA) 01 "An Act relating to the duties of the Department of Transportation and Public 02 Facilities; renaming the Alaska Marine Transportation Advisory Board the Alaska 03 Marine Highway Operations Board; relating to the membership and duties of the 04 Alaska Marine Highway Operations Board; relating to the comprehensive, intermodal, 05 long-range transportation plan for the state; and providing for an effective date." 06 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 07  * Section 1. AS 19.65.011 is amended to read: 08 Sec. 19.65.011. Short-term and comprehensive [COMPREHENSIVE]  09 long-range plans [PLAN]. The Department of Transportation and Public Facilities, in 10 consultation with the Alaska Marine Highway Operations [TRANSPORTATION 11 ADVISORY] Board, shall prepare a short-term and a comprehensive long-range 12 plan for the development and improvement of the Alaska marine highway system and 13 shall, in consultation with the Alaska Marine Highway Operations 01 [TRANSPORTATION ADVISORY] Board, revise and update the short-term plan 02 annually, and the comprehensive long-range plan at least every three [FIVE] 03 years. The department shall submit both the short-term and the comprehensive long- 04 range plans [PLAN] and revisions and updates of the plans [PLAN] to the legislature. 05  * Sec. 2. AS 19.65.110 is amended to read: 06 Sec. 19.65.110. Alaska Marine Highway Operations  07 [TRANSPORTATION ADVISORY] Board. There is established in the Department 08 of Transportation and Public Facilities the Alaska Marine Highway Operations 09 [TRANSPORTATION ADVISORY] Board. 10  * Sec. 3. AS 19.65.120(a) is repealed and reenacted to read: 11 (a) The board is composed of the following nine members, each of whom 12 must be a resident of the state: 13 (1) the head of the division of marine transportation; 14 (2) one representative, who may be retired, of a recognized union that 15 represents employees of the Alaska marine highway system, appointed by the 16 governor; 17 (3) one representative of an Alaska Native organization or tribe who is 18 from a community served by the Alaska marine highway system, appointed by the 19 governor; 20 (4) two public members who have experience in marine business and 21 procurement practices, marine personnel management, commercial service options, 22 ship maintenance, construction, and repair, fleet strategy, reliability, and regulatory 23 compliance, or risk management, appointed by the governor; 24 (5) two public members who have experience in marine business and 25 procurement practices, marine personnel management, commercial service options, 26 ship maintenance, construction, and repair, fleet strategy, reliability, and regulatory 27 compliance, or risk management, appointed by the speaker of the house of 28 representatives and who serve at the pleasure of the speaker of the house of 29 representatives; 30 (6) two public members who have experience in marine business and 31 procurement practices, marine personnel management, commercial service options, 01 ship maintenance, construction, and repair, fleet strategy, reliability, and regulatory 02 compliance, or risk management, appointed by the president of the senate and who 03 serve at the pleasure of the president of the senate. 04  * Sec. 4. AS 19.65.120(c) is amended to read: 05 (c) The members of the board, except for the head of the division of marine  06 transportation, shall serve staggered three-year terms. If a vacancy arises on the 07 board, the governor, the president of the senate, or the speaker of the house, as  08 applicable, shall, within 30 days after the vacancy arises, appoint a person to serve the 09 balance of the unexpired term. A person appointed to fill the balance of an unexpired 10 term shall serve on the board from the date of appointment until the expiration of the 11 term. 12  * Sec. 5. AS 19.65.120(d) is amended to read: 13 (d) A [BOARD MEMBERS SERVE AT THE PLEASURE OF THE 14 GOVERNOR. IN ADDITION, A] majority of the membership of the board may 15 remove a member, except for the head of the division of marine transportation, if 16 that member misses more than two meetings in a calendar year and has not been 17 previously excused. 18  * Sec. 6. AS 19.65.180 is amended by adding a new subsection to read: 19 (e) The board shall provide advice and recommendations to the commissioner 20 of transportation and public facilities concerning the operation and management of the 21 Alaska marine highway system, including advice and recommendations regarding 22 business to enhance revenue and reduce costs, personnel management, commercial 23 service options, ship maintenance, construction, and repair, fleet strategy, reliability, 24 and regulatory compliance, and other service objectives. 25  * Sec. 7. AS 19.65.195 is amended to read: 26 Sec. 19.65.195. Definition. In AS 19.65.110 - 19.65.195, "board" means the 27 Alaska Marine Highway Operations [TRANSPORTATION ADVISORY] Board. 28  * Sec. 8. AS 44.42.050(a) is amended to read: 29 (a) The commissioner shall develop a comprehensive, intermodal, long-range 30 transportation plan for the state. The commissioner shall incorporate the  31 comprehensive long-range plan prepared under AS 19.65.011 into the plan  01 developed under this section. The plan may be developed in multiple documents that 02 address logical components, including geographic areas, modes of transportation, 03 transportation corridors, systems, and other distinct subjects relevant to transportation 04 planning. The components of the plan shall be revised as the commissioner determines 05 appropriate. In developing and revising the state plan, the commissioner shall conform 06 to the requirements for the eligibility and use of federal and other funds, as applicable. 07 Upon approval of each component of the plan by the commissioner, the commissioner 08 shall transmit notice of the approval of that component to the governor and to the 09 legislature. 10  * Sec. 9. AS 19.65.120(b) is repealed.  11  * Sec. 10. The uncodified law of the State of Alaska is amended by adding a new section to 12 read: 13 ALASKA MARINE HIGHWAY OPERATIONS BOARD; TRANSITION. (a) The 14 terms of members who fill seats on the Alaska Marine Transportation Advisory Board under 15 AS 19.65.120(a), as it read on the day before the effective date of this Act, expire on the 16 effective date of this Act. 17 (b) Notwithstanding AS 19.65.120(c), as amended by sec. 4 of this Act, and 18 AS 39.05.055, the seats on the Alaska Marine Highway Operations Board established by 19 AS 19.65.120(a), as repealed and reenacted by sec. 3 of this Act, shall be filled as follows: 20 (1) the two public members appointed by the governor shall serve one-year 21 terms; 22 (2) the representative of an Alaska Native organization or tribe appointed by 23 the governor shall serve a one-year term; 24 (3) the members appointed by the speaker of the house of representatives shall 25 serve two-year terms; 26 (4) the union representative appointed by the governor and the members 27 appointed by the president of the senate shall serve three-year terms. 28 (c) The head of the division of marine transportation begins membership on the 29 Alaska Marine Highway Operations Board on the effective date of this Act. 30 (d) Nothing in this section prevents the appointment of a person whose term expires 31 under (a) of this section to the Alaska Marine Highway Operations Board, provided that the 01 person meets the qualifications in AS 19.65.120(a), as repealed and reenacted by sec. 3 of this 02 Act. 03  * Sec. 11. This Act takes effect January 1, 2022.
