01 "An Act prohibiting abortion after detection of fetal cardiac activity or fetal heart                                   
02 contractions."                                                                                                          
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 18.16 is amended by adding a new section to read:                                                  
05 Sec. 18.16.055. Abortion after fetal heartbeat detected. (a) Notwithstanding                                          
06 compliance with AS 18.16.010, a person may not knowingly perform an abortion after                                      
07 a health care provider detects a fetal heartbeat unless the abortion is medically                                       
08       necessary.                                                                                                        
09            (b)  The provisions of (a) of this section do not apply to a woman on whom an                                
10       abortion is performed.                                                                                            
11            (c)  Violation of (a) of this section is a class C felony.                                                   
12            (d)  In this section,                                                                                        
13                 (1)  "fetal heartbeat" means cardiac activity or the steady and repetitive                              
14       rhythmic contraction of the fetal heart within the gestational sac;                                               
01                 (2)  "health care provider" means a person who is licensed, registered,                                 
02       or otherwise authorized under AS 08 to provide health care services.
