01 "An Act relating to sentencing for vehicle theft in the first degree."                                                  
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 12.55.125(e) is amended to read:                                                                   
04 (e)  Except as provided in (i) of this section, a defendant convicted of a class C                                      
05 felony may be sentenced to a definite term of imprisonment of not more than five                                        
06 years, and shall be sentenced to a definite term within the following presumptive                                       
07       ranges, subject to adjustment as provided in AS 12.55.155 - 12.55.175:                                            
08                 (1)  if the offense is a first felony conviction and does not involve                                   
09       circumstances described in (4) of this subsection, zero to two years; a defendant                                 
10 sentenced under this paragraph may, if the court finds it appropriate, be granted a                                     
11 suspended imposition of sentence under AS 12.55.085, and the court may, as a                                            
12 condition of probation under AS 12.55.086, require the defendant to serve an active                                     
13       term of imprisonment within the range specified in this paragraph;                                                
14                 (2)  if the offense is a second felony conviction, one to four years;                                   
15                 (3)  if the offense is a third felony conviction, two to five years;                                    
01                 (4)  if the offense is a first felony conviction, and the defendant violated                            
02                      (A)  AS 08.54.720(a)(15), one to two years;                                                
03                      (B)  AS 11.46.360, 120 days to two years.                                                      
04    * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to                          
05 read:                                                                                                                   
06       APPLICABILITY. AS 12.55.125(e), as amended by sec. 1 of this Act, applies to                                      
07 offenses committed on or after the effective date of this Act.
