01 "An Act relating to the definition of 'supervision or direct supervision' for purposes of                               
02 medical assistance coverage of behavioral health clinic services."                                                      
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 47.07.030 is amended by adding a new subsection to read:                                           
05 (h)  For purposes of medical assistance coverage, the department may require                                            
06 behavioral health clinic services to be provided by or under the supervision or direct                                  
07 supervision of a psychiatrist licensed under AS 08.64. In this subsection, "supervision                                 
08 or direct supervision" means that a psychiatrist licensed under AS 08.64 is available to                                
09 provide clinical oversight or consultation to the supervisee either in person or by a                                   
10       communication device.                                                                                             
11    * Sec. 2. 7 AAC 135.030(e) is annulled.
