00 HOUSE JOINT RESOLUTION NO. 40 01 Proposing amendments to the Constitution of the State of Alaska relating to a 02 legislator's disqualification from nomination, election, or appointment. 03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04  * Section 1. Article II, sec. 5, Constitution of the State of Alaska, is amended to read: 05 Section 5. Disqualifications. (a) No legislator may hold any other office or 06 position of profit under the United States or the State. During the term for which 07 elected and for one year thereafter, no legislator may be nominated, elected, or 08 appointed to any other office or position of profit which has been created, or the salary 09 or emoluments of which have been increased, while he was a member. This section 10 shall not prevent any person from seeking or holding the office of governor, secretary 11 of state, or member of Congress. This section shall not apply to employment by or 12 election to a constitutional convention. 13  * Sec. 2. Article II, sec. 5, Constitution of the State of Alaska, is amended by adding a new 14 subsection to read: 15 (b) No legislator may be nominated, elected, or appointed to the legislature for 16 four years following the last day of the legislator's term if, during a regular legislative 01 session of the legislator's term, the legislature fails to pass a bill making appropriations 02 sufficient to cover the expenses of state government not later than one hundred twenty 03 consecutive calendar days from the date each regular session convenes. 04  * Sec. 3. Article XV, Constitution of the State of Alaska, is amended by adding a new 05 section to read: 06 Section 30. Application of 2018 Legislature Disqualification Amendment. 07 The 2018 amendment relating to a legislator's disqualification applies only to a 08 member of a state legislature that convenes in regular session after January 1, 2019. 09  * Sec. 4. The amendments proposed by this resolution shall be placed before the voters of 10 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the 11 State of Alaska, and the election laws of the state.
