00 HOUSE BILL NO. 171 01 "An Act authorizing the commissioner of corrections to enter into contracts and 02 cooperative agreements for the productive employment of prisoners; authorizing the 03 Department of Corrections to receive money from the productive employment of 04 prisoners; and providing for an effective date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06  * Section 1. AS 33.30.191(b) is repealed and reenacted to read: 07 (b) The commissioner may enter into contracts or cooperative agreements with 08 a public agency, private organization, or individual for the productive employment of 09 prisoners in the performance of services or production of articles, materials, and 10 supplies. A contract or agreement with an individual or private organization must 11 require payment to the commissioner of at least the minimum wage required by 12 AS 23.10.065 for each hour worked by a prisoner. The wage required under contract 13 or agreement multiplied by the total hours worked by the prisoner must be paid 14 weekly, or for another period as required by the contract. The commissioner may sell a 01 product or service under this subsection to a public agency, private organization, or 02 individual. Before selling a product or service, the commissioner shall consult with 03 industry representatives in the state to ensure that the services or products will have 04 the potential for contributing to the economy of the state and will have minimal 05 negative effect on an existing private industry or labor force in the state. The 06 commissioner shall determine the prices at which products and services will be sold, 07 based on the approximate fair market value of products and services of comparable 08 quality available from commercial sources. 09  * Sec. 2. AS 37.05.146(c) is amended by adding a new paragraph to read: 10 (90) receipts of the Department of Corrections from contracts or 11 agreements under AS 33.30.191. 12  * Sec. 3. This Act takes effect July 1, 2017.
