00 HOUSE BILL NO. 17 01 "An Act establishing a fish and game conservation program in the Department of Fish 02 and Game; and establishing a fish and wildlife conservation program account within the 03 fish and game fund." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05  * Section 1. AS 16.05.110(a) is amended to read: 06 (a) The fish and game fund shall be made up of the following money and other 07 money the legislature appropriates, which shall be deposited and retained in the fund 08 until expended: 09 (1) money received from the sale of state sport fishing, hunting, and 10 trapping licenses, tags, and special permits, waterfowl conservation tags purchased by 11 hunters, and anadromous salmon tags purchased by fishermen; 12 (2) proceeds received from the sale of furs, skins, and specimens taken 13 by predator hunters and other employees; 14 (3) money received in settlement of a claim or loss caused by damage 01 to the fish and game resources of the state; 02 (4) money received from federal, state, or other governmental unit, or 03 from a private donor for the fish and wildlife conservation program under  04 AS 16.05.352 or other fish and game purposes; 05 (5) interest earned on [UPON] money in the fund; 06 (6) money from any other source. 07  * Sec. 2. AS 16.05.130 is amended by adding a new subsection to read: 08 (h) Contributions and grants made under AS 16.05.352 to the fish and wildlife 09 conservation program in the department shall be deposited in a separate account in the 10 fish and game fund, which shall be known as the fish and wildlife conservation 11 program account. The department shall use appropriations to the fish and wildlife 12 conservation program from the account for activities intended to directly benefit fish 13 and wildlife conservation. In this subsection, "fish and wildlife conservation" does not 14 include intensive management programs intended to sustain and enhance big game 15 prey populations for human harvest under AS 16.05.255(e). 16  * Sec. 3. AS 16.05.352 is repealed and reenacted to read: 17 Sec. 16.05.352. Fish and wildlife conservation program. (a) The fish and 18 wildlife conservation program is established in the department. The purpose of the 19 program is to provide a person who does not support intensive management programs 20 under AS 16.05.255(e) a means of contributing to fish and wildlife conservation 21 efforts in the state. The department shall accept contributions and grants made to the 22 program for the purpose of and under conditions described in AS 16.05.050(a)(4) for 23 the direct benefit of fish and wildlife conservation, as specified in AS 16.05.130(h). 24 (b) As part of the program established by this section, the department shall 25 annually develop fish and wildlife conservation program emblems. The department 26 shall, by appropriate means, provide for the selection of designs for the emblems and 27 for the production of the selected designs in mediums and in quantities that the 28 commissioner considers appropriate. The department shall provide a person who 29 makes a grant or contribution under (a) of this section of $20 or more with a decal, 30 certificate, artwork, or other form of recognition that bears a conservation emblem. 31 The department may provide different forms of recognition for different amounts of 01 contributions or grants to the program. 02 (c) Funds provided to the department under this section shall be deposited in 03 the fish and wildlife conservation account established under AS 16.05.130(h) and used 04 for the purposes provided in this section.
