01 "An Act relating to standards for licensure or certification established by the                                         
02 Department of Health and Social Services."                                                                              
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 47.05.310(g) is amended to read:                                                                   
05            (g)  The department shall adopt regulations listing those criminal offenses that                             
06       are inconsistent with the standards for licensure or certification by the department.                             
07       The regulations may not provide that the offense of assault in the fourth degree                              
08       under AS 11.41.230, or an offense with similar elements in this or another                                    
09       jurisdiction, is inconsistent with the standards for licensure or certification for                           
10       more than one year from the date of a person's unconditional discharge from a                                 
11       conviction unless the offense is a crime involving domestic violence. In this                                 
12       subsection,                                                                                                   
13                 (1)  "crime involving domestic violence" has the meaning given in                                   
14       AS 18.66.990; and                                                                                             
01                 (2)  "unconditional discharge" has the meaning given in                                             
02       AS 12.55.185.                                                                                                 
03    * Sec. 2. 7 AAC 10.905(d)(1)(A) is annulled.
