01 "An Act relating to the use of electronic devices while driving."                                                       
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 28.35.161(a) is amended to read:                                                                   
04            (a)  A person commits the crime of driving while texting, while                                              
05       communicating on a computer, or while a screen device is operating if the person is                               
06       driving a motor vehicle on a highway or vehicular way in the state, and                                       
07                 (1)  the vehicle has a television, video monitor, portable computer, or                                 
08       any other similar means capable of providing a visual display that is in full view of a                           
09       driver in a normal driving position while the vehicle is in motion, and the monitor or                            
10       visual display is operating while the person is driving; or                                                       
11                 (2)  the person is reading or typing a text message or other nonvoice                                   
12       message or communication on a cellular telephone, personal data assistant, computer,                              
13       or any other similar means capable of providing a visual display that is in the view of                           
14       the driver in a normal driving position except when the vehicle is                                            
15                      (A)  lawfully parked, standing, or stopped and is not in a                                     
01            roadway; or                                                                                              
02                      (B)  stopped because it is inoperable [WHILE THE                                               
03            VEHICLE IS IN MOTION AND WHILE THE PERSON IS DRIVING].
