00 HOUSE BILL NO. 202 01 "An Act raising the application fee for a drawing permit for the hunting of bison to $20; 02 requiring the game management plan for bison in the Delta Junction Bison Range Area 03 to include mitigation of bison damage to farm crops and farm and personal property; 04 and authorizing the commissioner of natural resources to make grants to mitigate or 05 prevent damage caused by bison." 06 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 07  * Section 1. AS 16.05.346(b) is amended to read: 08 (b) The application fee for a drawing permit issued by the department for the 09 hunting of bison is $20 [$10]. 10  * Sec. 2. AS 16.20.310(b) is amended to read: 11 (b) The game management plan must include [, BUT IS NOT LIMITED TO] 12 (1) planting grains for bison and planting other wildlife forage; 13 (2) altering existing plant cover to create additional range and year- 01 round habitat for bison and other animal species in the area; 02 (3) tilling to produce forage;  03 (4) mitigating bison damage to farm crops and farm and personal  04 property. 05  * Sec. 3. AS 38.05.020(b) is amended to read: 06 (b) The commissioner may 07 (1) establish reasonable procedures and adopt reasonable regulations 08 necessary to carry out this chapter and, whenever necessary, issue directives or orders 09 to the director to carry out specific functions and duties; regulations adopted by the 10 commissioner shall be adopted under AS 44.62 (Administrative Procedure Act); 11 orders by the commissioner classifying land, issued after January 3, 1959, are not 12 required to be adopted under AS 44.62 (Administrative Procedure Act); 13 (2) enter into agreements considered necessary to carry out the 14 purposes of this chapter, including agreements with federal and state agencies; 15 (3) review any order or action of the director; 16 (4) exercise the powers and do the acts necessary to carry out the 17 provisions and objectives of this chapter; 18 (5) notwithstanding the provisions of any other section of this chapter, 19 grant an extension of the time within which payments due on any exploration license, 20 lease, or sale of state land, minerals, or materials may be made, including payment of 21 rental and royalties, on a finding that compliance with the requirements is or was 22 prevented by reason of war, riots, or acts of God; 23 (6) classify tracts for agricultural uses; 24 (7) after consulting with the Board of Agriculture and Conservation 25 (AS 03.09.010), waive, postpone, or otherwise modify the development requirements 26 of a contract for the sale of agricultural land if 27 (A) the land is inaccessible by road; or 28 (B) transportation, marketing, and development costs render 29 the required development uneconomic; 30 (8) reconvey or relinquish land or an interest in land to the federal 31 government if 01 (A) the land is described in an amended application for an 02 allotment under 43 U.S.C. 1617; and 03 (B) the reconveyance or relinquishment is 04 (i) for the purposes provided in 43 U.S.C. 1617; and 05 (ii) in the best interests of the state; 06 (9) lead and coordinate all matters relating to the state's review and 07 authorization of resource development projects; 08 (10) exercise the powers and do the acts necessary to carry out the 09 provisions and objectives of AS 43.90 that relate to this chapter;  10 (11) make grants to persons whose property or crops have been  11 damaged, or are likely to be damaged, by bison and to persons that assist persons  12 whose property or crops have been damaged or are likely to be damaged by  13 bison, to mitigate or prevent bison damage; grants made under this paragraph  14 may be used for fencing costs.
