00 HOUSE BILL NO. 146 01 "An Act relating to proof of motor vehicle liability insurance; and providing for an 02 effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04  * Section 1. AS 28.22.019(a) is amended to read: 05 (a) A person shall have proof of motor vehicle liability insurance in the 06 person's immediate possession at all times when driving a motor vehicle, and shall 07 present the proof for inspection upon the demand of a peace officer or other authorized 08 representative of the Department of Public Safety. A person may display the proof  09 on a mobile electronic device. However, a person charged with violating this section 10 may not be convicted if the person produces in court or in the office of the arresting or 11 citing officer proof of motor vehicle liability insurance previously issued to the person 12 that was valid at the time of the person's arrest or citation. 13  * Sec. 2. AS 28.22.019(d) is amended to read: 14 (d) In this section, 01 (1) "mobile electronic device" means a portable computing and  02 communication device that has a display screen with touch input or a miniature  03 keyboard;  04 (2) "proof" means 05 (A) a copy of the insurance policy or certificate of self- 06 insurance that is in effect; 07 (B) [OR] a printed card or electronic certification from an 08 insurance company, insurance agent, insurance broker, or surplus lines broker 09 that a policy that complies with AS 28.22.011 is in effect; or  10 (C) the display on a mobile electronic device of verification  11 that a policy that complies with AS 28.22.011 is in effect. 12  * Sec. 3. AS 28.22.019 is amended by adding a new subsection to read: 13 (e) Displaying proof of motor vehicle liability insurance on a mobile 14 electronic device under this section does not constitute consent for a peace officer or 15 other authorized representative of the Department of Public Safety to access other 16 contents of the mobile electronic device. 17  * Sec. 4. This Act takes effect July 1, 2013.
