00 HOUSE BILL NO. 369 01 "An Act relating to student participation in sports." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03  * Section 1. AS 14.30.142(d) is amended to read: 04 (d) A student who has been removed from participation in a practice or game 05 for suspicion of concussion may not return to participation in practice or game play 06 until the student has been evaluated and cleared for participation in writing by a 07 qualified person who has received training [AND IS CURRENTLY CERTIFIED, AS 08 VERIFIED IN WRITING OR ELECTRONICALLY BY THE QUALIFIED 09 PERSON,] in the evaluation and management of concussions. In this subsection, 10 "qualified person" means either a 11 (1) health care provider who is licensed in the state or exempt from 12 licensure under state law; or 13 (2) person who is acting at the direction and under the supervision of a 14 physician who is licensed in the state or exempt from licensure under 15 AS 08.64.370(1), (2), or (4). 01  * Sec. 2. AS 14.30 is amended by adding a new section to read: 02 Sec. 14.30.365. Interscholastic athletics; eligibility. (a) A student who is 03 enrolled full time in an alternative education program that is located entirely in the 04 state and that does not offer interscholastic sports is eligible to participate in any 05 interscholastic sports program available in the public school that the student would be 06 eligible, based on the residence of the parent or legal guardian of the student, to attend 07 if the student were not enrolled in an alternative education program if the student 08 (1) is otherwise eligible to participate in interscholastic sports under 09 requirements established by the school, the school district, and the corresponding 10 sports governing body; 11 (2) provides documentation to the school providing the interscholastic 12 sports program of the student's eligibility to participate, including academic 13 transcripts, proof of full-time enrollment, medical documents, and disciplinary 14 records; and 15 (3) claims the same school for interscholastic sports eligibility 16 purposes during a school year. 17 (b) In this section, 18 (1) "alternative education program" means a public secondary school 19 that provides a nontraditional education program, including the Alaska Military Youth 20 Academy; a public vocational, remedial, or theme-based program; a home school 21 program that is accredited by an external accrediting body; a charter school authorized 22 under AS 14.03.250 - 14.03.290; and a statewide correspondence school that enrolls 23 students who reside outside of the district in which the student resides and provides 24 less than three hours a week of scheduled face-to-face student interactions in the same 25 location with a teacher who is certified under AS 14.20.020; 26 (2) "district" has the meaning given in AS 14.17.990; 27 (3) "full-time student" means a student who 28 (A) is enrolled in not less than five credits in grades nine 29 through 11 and not less than four credits in grade 12; 30 (B) is on track to graduate from secondary school in not more 31 than four years of attendance in secondary school; and 01 (C) if a student in grade 12, has passed all parts of the 02 secondary school competency examination required under AS 14.03.075; 03 (4) "interscholastic sports program" means a sport event or 04 competition with another school.
