00 HOUSE JOINT RESOLUTION NO. 41 01 Proposing amendments to the Constitution of the State of Alaska relating to annexations 02 of areas to and detachments of areas from cities and organized boroughs. 03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04  * Section 1. Article X, sec. 12, Constitution of the State of Alaska is amended to read: 05 Section 12. Boundaries. (a) A local boundary commission or board shall be 06 established by law in the executive branch of the state government. The commission 07 or board may consider any proposed local government boundary change. It may 08 present proposed changes to the legislature during the first ten days of any regular 09 session. Subject to (b) of this section, the [THE] change becomes [SHALL 10 BECOME] effective [FORTY-FIVE DAYS AFTER PRESENTATION OR] at the 11 end of the session [, WHICHEVER IS EARLIER,] unless disapproved during that  12 session by a resolution concurred in by a majority of the members of each house. The 13 commission or board, subject to law, may establish procedures whereby boundaries 14 may be adjusted by local action. 15  * Sec. 2. Article X, sec. 12, Constitution of the State of Alaska is amended by adding a new 16 subsection to read: 01 (b) Unless no voters reside within the area, a proposed annexation to or 02 detachment from a city or an organized borough is subject to approval by a majority of 03 the voters voting on the question who reside within the area proposed for annexation 04 or detachment. 05  * Sec. 3. The amendments proposed by this resolution shall be placed before the voters of 06 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the 07 State of Alaska, and the election laws of the state.
