00 HOUSE JOINT RESOLUTION NO. 3 01 Proposing an amendment to the Constitution of the State of Alaska requiring an 02 affirmative vote of the people before any form of gambling for profit may be authorized 03 in Alaska and setting other requirements. 04 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05  * Section 1. Article XII, Constitution of the State of Alaska, is amended by adding a new 06 section to read: 07 Section 15. For-Profit Gambling. (a) Any form of gaming or gambling for 08 profit is prohibited in the State unless that form of gaming or gambling has been 09 authorized by law, ratified by a majority vote of the qualified voters of the State who 10 vote on the question at the next general election, and approved at an election in the 11 organized borough or city where the gaming or gambling may occur by a majority of 12 qualified voters who vote on the question. If the gaming or gambling will occur in an 13 unincorporated community in the unorganized borough, then the gaming must be 14 approved by a majority of qualified voters who vote on the question in the 15 unincorporated community, as defined by law. 01 (b) This section does not prohibit or restrict any form of gaming lawfully 02 conducted under Alaska law on the date of the ratification of this section by the people 03 of Alaska, nor does this section affect the authority of the legislature to authorize or 04 regulate nonprofit gaming by organized boroughs and cities or by nonprofit 05 organizations. 06  * Sec. 2. The amendment proposed by this resolution shall be placed before the voters of the 07 state at the next general election in conformity with art. XIII, sec. 1, Constitution of the State 08 of Alaska, and the election laws of the state.
