00 Enrolled HB 168 01 Relating to state certification and designation of trauma centers; creating the trauma care fund 02 to offset trauma care provided at certified and designated trauma centers; and providing for an 03 effective date. 04 _______________ 05  * Section 1. AS 18.08.082 is amended by adding a new subsection to read: 06 (c) The commissioner shall establish special designations in regulation for 07 varying levels of trauma care provided by any certified trauma center in the state that 08 shall be used to set compensation eligibility and amounts under AS 18.08.085. The 09 designations shall be based on nationally recognized standards and procedures. 10  * Sec. 2. AS 18.08 is amended by adding a new section to read: 11 Sec. 18.08.085. Trauma care fund; creation. (a) The trauma care fund is 12 created. The purpose of the fund is to compensate certified trauma centers in the state 13 that receive a special designation under AS 18.08.082(c) and that achieve or maintain 14 the highest appropriate level of trauma care designation. 01 (b) The fund consists of money appropriated to it by the legislature, including 02 donations, recoveries of or reimbursements for awards made from the fund, income 03 from the fund, and other program receipts from activities under this chapter. 04 Appropriations to the fund do not lapse. 05 (c) The commissioner shall administer the fund in accordance with the 06 provisions of this chapter. The commissioner shall spend money from the trauma care 07 fund for the purpose established in (a) of this section. 08 (d) The commissioner shall establish compensation standards under this 09 section. The standards must include funding priorities for trauma centers receiving a 10 special designation under AS 18.08.082(c). The commissioner may seek the advice of 11 a special committee for review of statewide trauma care and compensation standards. 12 (e) The commissioner may not provide more than 25 percent of the total 13 assets, including earnings, of the fund in a fiscal year to one trauma center. 14  * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).
