00                 CS FOR SENATE JOINT RESOLUTION NO. 14(FIN)                                                              
01 Proposing amendments to the Constitution of the State of Alaska relating to the budget                                  
02 reserve fund.                                                                                                           
03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
04    * Section 1. Article IX, sec. 17(c), Constitution of the State of Alaska is amended to read:                       
05            (c)  An appropriation from the budget reserve fund may be made for any public                                
06       purpose upon affirmative vote of two-thirds [THREE-FOURTHS] of the members of                                 
07       each house of the legislature.                                                                                    
08    * Sec. 2. Article IX, sec. 17(d), Constitution of the State of Alaska is amended to read:                          
09            (d)  If an appropriation is made from the budget reserve fund, until the amount                              
10       appropriated is repaid, the amount of money in the general fund available for                                     
11       appropriation at the end of each succeeding fiscal year shall be deposited in the budget                          
12       reserve fund. For purposes of this subsection, each amount deposited into the fund                            
13       under (a) of this section shall be treated as a repayment of money appropriated                               
14       from the fund. If the amount deposited under (a) of this section exceeds the                                  
15       amount due in repayment, the excess amount shall be treated as a credit to be                                 
16       applied as a repayment of money appropriated from the fund in the future. The                                 
01       legislature shall implement this subsection by law.                                                               
02    * Sec. 3. The amendments proposed by this resolution shall be placed before the voters of                          
03 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the                        
04 State of Alaska, and the election laws of the state.
