01 Relating to an aggravating factor at sentencing concerning the knowledge of the defendant                               
02 regarding the vulnerability or incapability of resistance of the victim due to homelessness.

04    * Section 1. AS 12.55.155(c)(5) is amended to read:                                                                
05                 (5)  the defendant knew or reasonably should have known that the                                        
06       victim of the offense was particularly vulnerable or incapable of resistance due to                               
07       advanced age, disability, ill health, homelessness, or extreme youth or was for any                           
08       other reason substantially incapable of exercising normal physical or mental powers of                            
09       resistance;                                                                                                       
10    * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to                          
11 read:                                                                                                                   
12       APPLICABILITY. This Act applies to offenses committed on or after the effective                                   
13 date of this Act.
