00                 SPONSOR SUBSTITUTE FOR SENATE BILL NO. 208                                                              
01 "An Act relating to sexual offenses."                                                                                   
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 11.41.470(8) is amended to read:                                                                   
04                 (8)  "without consent" means that a person                                                              
05                      (A)  with or without resisting, is coerced by the use of force                                     
06            against a person or property, or by the express or implied threat of death,                                  
07            imminent physical injury, or kidnapping to be inflicted on anyone; [OR]                                      
08                      (B)  is incapacitated as a result of an act of the defendant; or                               
09                      (C)  with or without resisting, communicates orally or in                                      
10            writing, or expresses through direct action of that person, the person's                                 
11            lack of consent or revocation of any consent previously given by that                                    
12            person.
