01 "An Act relating to sexual assault."                                                                                    
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 11.41.470(8) is amended to read:                                                                   
04                 (8)  "without consent" means that a person                                                              
05                      (A)  with or without resisting, is coerced by the use of force                                     
06            against a person or property, or by the express or implied threat of death,                                  
07            imminent physical injury, or kidnapping to be inflicted on anyone; [OR]                                      
08                      (B)  is incapacitated as a result of an act of the defendant; or                               
09                      (C)  with or without resisting, communicates  orally, in                                       
10            writing, or by direct action the person's lack of consent or revocation of                               
11            consent previously given.
