00                             SENATE BILL NO. 12                                                                          
01 "An Act relating to sport fishing services and sport fishing guide services."                                           
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 16.40.260(b) is amended to read:                                                                   
04            (b)  A person may not provide sport fishing services unless the person                                       
05                 (1)  holds a current sport fishing operator license and has current                                 
06       insurance coverage as required in (a)(2) of this section; or                                                  
07                 (2)  is hired by a business to provide services to clients or potential                             
08       clients of that business if the clients or potential clients being provided with the                          
09       sport fishing services do not pay a portion of the cost of the services; in this                              
10       paragraph,                                                                                                    
11                      (A)  "business" means a corporation, company, partnership,                                     
12            firm, association, organization, business trust, or society that is licensed to                          
13            do business in this state;                                                                               
14                      (B)  "cost of the services" means all costs associated with                                    
15            sport fishing services, excluding transportation costs to and from the state.                            
01    * Sec. 2. AS 16.40.270(c) is amended to read:                                                                      
02            (c)  A person may not provide sport fishing guide services unless the person                                 
03                 (1)  holds                                                                                              
04                      (A)  a current sport fishing guide license; and                                                
05                      (B) [(2)  HOLDS] a current sport fishing operator license or is                                
06            an employee of a person who holds a current sport fishing operator license; or                           
07                 (2)  is hired by a business to provide services to clients or potential                             
08       clients of that business if the clients or potential clients being provided with the                          
09       sport fishing guide services do not pay a portion of the cost of the services; in this                        
10       paragraph,                                                                                                    
11                      (A)  "business" has the meaning given in                                                       
12            AS 16.40.260(b)(2);                                                                                      
13                      (B)  "cost of the services" has the meaning given in                                           
14            AS 16.40.260(b)(2).
