00 CS FOR SENATE BILL NO. 5(JUD) 01 "An Act relating to reporting of certain crimes." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03  * Section 1. AS 11.56.765(a) is amended to read: 04 (a) A person, other than the victim, commits the crime of failure to report a 05 violent crime [COMMITTED AGAINST A CHILD] if the person 06 (1) witnesses what the person knows or reasonably should know is 07 (A) the murder or attempted murder of a person [CHILD] by 08 another; 09 (B) the kidnapping or attempted kidnapping of a person 10 [CHILD] by another; 11 (C) the sexual penetration or attempted sexual penetration by 12 another 13 (i) of a person [CHILD] without consent of the person 14 [CHILD]; 15 (ii) of a person [CHILD] that is mentally incapable; 01 (iii) of a person [CHILD] that is incapacitated; or 02 (iv) of a person [CHILD] that is unaware that a sexual 03 act is being committed; or 04 (D) the assault of a person [CHILD] by another causing 05 serious physical injury to the person [CHILD]; and  06 (2) [KNOWS OR REASONABLY SHOULD KNOW THAT THE 07 CHILD IS UNDER 16 YEARS OF AGE; AND 08 (3)] does not as soon as reasonably practicable [IN A TIMELY 09 MANNER] report that crime to a peace officer or law enforcement agency. 10  * Sec. 2. AS 11.53.765(d) is amended to read: 11 (d) Failure to report a violent crime [COMMITTED AGAINST A CHILD] is 12 a 13 (1) class C felony if the crime not reported is an unclassified  14 felony; or  15 (2) class A misdemeanor if the crime not reported is other than an  16 unclassified felony.
