01 "An Act relating to requiring subcontractors without employees acting as independent                                    
02 contractors to secure payment for workers' compensation."                                                               
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 23.30.045 is amended by adding a new subsection to read:                                           
05            (g)  A subcontractor who is hired by a contractor as an independent contractor                               
06       and who has no employees during the term of the contract shall secure the payment of                              
07       compensation payable under AS 23.30.041, 23.30.050, 23.30.095, 23.30.145, and                                     
08       23.30.180 - 23.30.215 that provides coverage for the subcontractor. If                                            
09                 (1)  the subcontractor fails to secure the payment of compensation                                      
10       required by this subsection, the contractor is liable for and shall secure the payment of                         
11       the compensation for the subcontractor;                                                                           
12                 (2)  the contractor fails to secure the payment of compensation for the                                 
13       subcontractor when required by (1) of this subsection, the project owner is liable for                            
14       and shall secure the payment of the compensation required by this subsection.
