00 HOUSE BILL NO. 360 01 "An Act relating to dialysis technicians." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03  * Section 1. AS 08.68.100(a) is amended to read: 04 (a) The board shall 05 (1) adopt regulations necessary to implement this chapter, including 06 regulations 07 (A) pertaining to practice as an advanced nurse practitioner and 08 a nurse anesthetist; 09 (B) [, AND REGULATIONS] necessary to implement 10 AS 08.68.331 - 08.68.336 relating to certified nurse aides in order to protect 11 the health, safety, and welfare of clients served by nurse aides; and  12 (C) pertaining to practice as a dialysis technician; 13 (2) approve curricula and adopt standards for basic education programs 14 that prepare persons for licensing under AS 08.68.190; 15 (3) provide for surveys of the basic nursing education programs in the 01 state at the times it considers necessary; 02 (4) approve education programs that meet the requirements of this 03 chapter and of the board, and deny, revoke, or suspend approval of education 04 programs for failure to meet the requirements; 05 (5) examine, license, and renew the licenses of qualified applicants; 06 (6) prescribe requirements for competence before a former nurse may 07 resume the practice of nursing under this chapter; 08 (7) define by regulation the qualifications and duties of the executive 09 secretary and delegate authority to the executive secretary that is necessary to conduct 10 board business; 11 (8) develop reasonable and uniform standards for nursing practice; 12 (9) publish advisory opinions regarding whether nursing practice 13 procedures or policies comply with acceptable standards of nursing practice as defined 14 under this chapter; 15 (10) require applicants under this chapter to submit fingerprints and the 16 fees required by the Department of Public Safety under AS 12.62.160 for criminal 17 justice information and a national criminal history record check; the department shall 18 submit the fingerprints and fees to the Department of Public Safety for a report of 19 criminal justice information under AS 12.62 and a national criminal history record 20 check under AS 12.62.400. 21  * Sec. 2. AS 08.68 is amended by adding a new section to read: 22 Article 5A. Dialysis Technicians.  23 Sec. 08.68.391. Dialysis technicians. (a) The board or the Department of 24 Commerce, Community, and Economic Development, as designated by the board, 25 shall certify a qualified applicant as a dialysis technician. The board, after consulting 26 with affected agencies, may adopt regulations regarding the certification of dialysis 27 technicians, including 28 (1) the training, educational, and other qualifications for certification 29 that will ensure that the dialysis technicians are competent to perform the tasks of their 30 occupation; 31 (2) application, certification, renewal, suspension, and revocation 01 procedures; and 02 (3) maintenance of a registry of dialysis technicians. 03 (b) The board may 04 (1) conduct hearings upon charges against a certified dialysis 05 technician of alleged violations of this chapter or regulations adopted under it; and 06 (2) invoke, or request the department to invoke, disciplinary action 07 under AS 08.01.075 against a certified dialysis technician. 08 (c) The Department of Commerce, Community, and Economic Development 09 shall set fees under AS 08.01.065 for dialysis technicians for each of the following: 10 (1) application; 11 (2) examination; 12 (3) certification; and 13 (4) renewal of certification. 14 (d) A person may not use the title "dialysis technician" unless the person is 15 certified under this chapter. A person who knowingly violates this subsection is guilty 16 of a class B misdemeanor. In this subsection, "knowingly" has the meaning given in 17 AS 11.81.900(a).
