00 HOUSE BILL NO. 219 01 "An Act requiring that light bulbs sold or offered for sale in the state for certain uses 02 must have a certain light output for each unit of energy, and requiring labeling of 03 noncomplying light bulbs; and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05  * Section 1. AS 46.11 is amended by adding a new section to read: 06 Article 2. Light Bulb Energy.  07 Sec. 46.11.200. Light bulb energy efficiency. (a) A person may not sell or 08 offer for sale a light bulb for home or office lighting in the state that has an energy 09 efficiency rating of less than 40 lumens for each watt. 10 (b) A light bulb with an efficiency rating of less than 40 lumens for each watt 11 that uses a home or office lighting socket type may only be sold if the packaging 12 clearly indicates that the light bulb is not intended for home or office use. 13 (c) The commissioner of environmental conservation shall adopt regulations 14 to implement this section, including regulations defining what constitutes home and 01 office lighting, home and office lighting socket types, operating conditions, and 02 packaging requirements. 03 (d) A person who violates (a) or (b) of this section is guilty of a violation and 04 is subject to sentencing under AS 12.55. 05  * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 06 read: 07 APPLICABILITY. AS 46.11.200, enacted by sec. 1 of this Act, does not apply to a 08 vendor's inventory in the state before July 1, 2008. 09  * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 10 read: 11 TRANSITIONAL PROVISIONS: REGULATIONS. The commissioner of 12 environmental conservation may proceed to adopt regulations necessary to implement the 13 changes made by this Act. The regulations take effect under AS 44.62 (Administrative 14 Procedure Act), but not before the effective date of the law implemented by the regulation. 15  * Sec. 4. Section 3 of this Act takes effect immediately under AS 01.10.070(c). 16  * Sec. 5. Except as provided in sec. 4 of this Act, this Act takes effect July 1, 2008.
