01 Relating to discipline of big game hunting guides and transporters and to providing field

04    * Section 1. AS 08.54.710(a) is amended to read:                                                                   
05            (a)  The board may impose a disciplinary sanction in a timely manner under (c)                               
06       of this section if the board finds [, AFTER A HEARING,] that a licensee                                           
07                 (1)  is convicted of a violation of any state or federal statute or                                     
08       regulation relating to hunting or to provision of big game hunting services or                                    
09       transportation services;                                                                                          
10                 (2)  has failed to file records or reports required under this chapter;                                 
11                 (3)  has negligently misrepresented or omitted a material fact on an                                    
12       application for any class of guide license or a transporter license; or                                           
13                 (4)  has breached a contract to provide big game hunting services or                                    
14       transportation services to a client.                                                                            
01    * Sec. 2. AS 08.54 is amended by adding a new section to read:                                                     
02            Sec. 08.54.785. Chapter not applicable. The provisions of this chapter do not                              
03       apply to a person providing, for compensation or with the intent to receive                                       
04       compensation, only accommodations to a big game hunter in the field at                                            
05                 (1)  a permanent lodge, house, or cabin on private land owned by the                                    
06       person; or                                                                                                        
07                 (2)  a state or federal cabin on state or federal land.                                                 
08    * Sec. 3. AS 08.54.790(9) is amended to read:                                                                      
09                 (9)  "outfit" means to provide, for compensation or with the intent to                                  
10       receive compensation, services, supplies, or facilities, excluding the provision of                           
11       accommodations by a person described in AS 08.54.785, to a big game hunter in                                 
12       the field, by a person who neither accompanies nor is present with the big game hunter                            
13       in the field either personally or by an assistant;                                                                
14    * Sec. 4. AS 08.54.710(b) and 08.54.710(i) are repealed.
